The current law passed in the European Parliament is based on the proposal of the European Union Commission from 2021. Accordingly, systems that are considered particularly dangerous and are used, for example, in critical infrastructure or in education and healthcare, must meet strict requirements. Also, some AI applications that violate EU values ​​should be banned entirely. This includes, for example, the assessment of social behavior (“social scoring”). This divides, among others, Chinese citizens into behavioral categories, and there should not be such emotion recognition in workplaces or educational institutions in the EU.

On this basis, facial recognition in public places. – for example through video surveillance in public places – should not normally be allowed. However, there are exceptions: police and other security officials should be allowed to use such facial recognition in public spaces to prosecute specific crimes such as human trafficking or terrorism.

Negotiators from the European Parliament and EU countries had already agreed on the provisions after lengthy negotiations in December. At the beginning of February, the representatives of the EU countries also officially agreed to this proposal. For member states, this now means that they must first phase out the banned systems.
