After the great operation of the Palestinian Islamic Resistance (Hamas) on October 7, 2023 (15 Mehr 1402) against the Zionists, the occupying regime committed genocide against the Palestinians in the Gaza Strip.
The forces of the occupying army completely surrounded this strip by preventing the entry of fuel, food, drinking water and medicine into Gaza. In January, South Africa filed a complaint against the Zionist regime on charges of genocide, and brought this regime to the International Court of Justice based in The Hague.
The Supreme Court, under the supervision of the United Nations, ordered Tel Aviv to take all necessary measures to prevent any illegal action under the Genocide Convention by issuing temporary rulings in late January. However, no ceasefire order was issued.
“Ziyad Ibrahim Patel“, a human rights lawyer from South Africa who is a consultant in the case of this country’s complaint against Israel in The Hague. is legal, as the first speaker of this conference, referring to the challenges of implementing the order of the International Court of Justice, he said that we must use the capacities of domestic laws to stop war crimes.
He emphasized: We should try to direct the public opinion of the world towards the genocide that is going on in Gaza and use the national capacities and force Israel through the organization of international campaigns. Let’s execute the judgment of the court.
Patel clarified: Independent countries should also declare their solidarity with the Palestinians along with the internal judicial organizations. Today, we see that in the countries that support Israel, people openly protest against the Zionist regime, and the student movements that are happening these days are just the beginning of changes, and in a short period of time, we will witness great changes in the world. Political and economic sanctions against the Zionist regime are one of the effective methods through which countries are able to put pressure on Israel. Also, sending weapons and military aid to Israel should be stopped.
He added: What is happening in Palestine is a violation of the UN resolution and collective punishment of Palestinians and a war crime. We must try to show Israel’s terrorist actions. Based on the resolutions of the Security Council and the General Assembly, all member states of the Rome Statute must ensure that the International Criminal Court implements its obligations and legal requirements.
“Samer Maher Abdullah”, a lawyer and professor at the University of Lebanon, was the second speaker and emphasized that the resistance axis and the Palestinian people They have the right to defend themselves in any possible way because what is happening in Gaza is against all international regulations.
According to him, after October 7th, the resistance created a new challenge by capturing several Zionists. He also emphasized that South Africa took effective action according to the Convention on the Prohibition of Genocide.
Maher pointed out that the main responsible for these crimes is America, which provides military aid to Israel. The temporary order of the International Court of Justice was a victory for the axis of resistance and anti-Zionist countries. The International Criminal Court is able to issue judgments because Palestine is a member of this court and the crimes we are talking about occur in Palestinian territory.
The third speaker was “Omar Rovahi“, a member of the International Bar Association and a professor at Algeria University. According to him, the dismissal of the prosecutor of the International Court of Justice due to the failure to manage the war crimes case in Gaza is an important issue.
He added: The double standard of the court, especially the prosecutor in case management, endangers the status and role of the International Court of Justice.> Don’t. According to Article 46 of the Rome Statute, the prosecutor can be charged for failing to manage the case and ignoring the crimes committed in Rafah occurs, complained.
