The application of Israeli laws in the West Bank is unjustifiable

The head of the International Court of Justice emphasized that this court is examining the judicial consequences of political actions and their reflections and effects on the occupied Palestinian territories.

According to Webangah News quoted by Mehr News Agency quoted by Al-Mayadin, Nawaf Salam, the head of the International Court of Justice emphasized that this court is examining the judicial consequences of political actions and their reflections and effects on the occupied Palestinian lands.

He added that the International Court of Justice does not have any restrictions to express its opinion on the degree of contradiction between political actions and international laws. Providing an advisory opinion on the occupation of Palestinian lands by the Zionist regime is within the jurisdiction of this court.

He emphasized that the occupied territories of Palestine are integrated, sovereign and connected territories that should be respected.

The head of the International Court of Justice stated that the current advisory opinion will not include the war that started in Gaza on October 7th.

Nawaf Salam stated that this court will examine the legal consequences of the illegal and illegitimate existence of Israel in the occupied Palestinian territories.

Salam said that the advisory opinion of this court is based on the hypothesis that Palestinian lands are occupied lands.

He also stated that the Zionist regime continues to blockade the Gaza Strip by land, sea and air.

Nawaf Salam pointed out that the duties and responsibilities of the Zionist regime are subject to the 1959 treaty regarding the way of interacting with civilians during war.

Salam said that the Zionist regime has violated its obligations under the 1965 Anti-Racial Discrimination Treaty.

He said that the Palestinian nation, which is recognized according to the Oslo Treaty, has the right to determine its own destiny.

The head of the International Court of Justice stated that the actions of the Zionist regime after the occupation of Palestinian lands in 1967 violated the right to self-determination of the Palestinian nation.

Nawaf Salam said that the International Court of Justice believes that the occupation is a temporary situation due to military necessity.

Salaam stated that we believe that the continued occupation of Palestinian lands for a long period of time will not change its legal status.

He emphasized that the occupying regime cannot move the residents of the occupied territories or resettle some of its citizens there.

Salam clarified that the transfer of settlers to the West Bank or East Jerusalem is against Article 49 of the Geneva Convention.

He stated: About 11 thousand Palestinian residential units have been demolished since 2009 under the pretext of not having a permit. The development of settlements in the West Bank and Quds and the creation of a barrier wall have strengthened the invaders. Israel’s actions have caused Palestinians to move from the occupied lands, especially in Area C in the West Bank.

He stated that the confiscation of Palestinian property and real estate by the Zionist settlers is against the international obligations of the Zionist regime.

Nawaf Salam said that the occupying forces are required to deliver water and food to the residents of the occupied areas.

Salam stated that the Zionist regime has violated its duty to administer the occupied territories.

He pointed out: Israel’s policy of exploiting the natural resources of the occupied territories is in conflict with its international obligations. Based on the evidence we have, “Israel” has expanded its jurisdiction over the West Bank rather than local laws. Israel considers East Jerusalem a part of its territory. This court is not convinced that the extension of the application of Israeli laws in the West Bank and Jerusalem is justified.

Nawaf Salam emphasized that the Zionist regime has imposed its sovereignty as an occupying power in a manner contrary to articles 53 and 64 of the Geneva Convention.

Salam said: In our opinion, moving the residents of the occupied lands from their land is mandatory and this is contrary to Israel’s commitments.

He stressed that confiscation of Palestinian lands by the Zionist regime and granting it to settlers is not temporary and is against the Geneva Convention.

Salaam stated: We believe that Israel has failed in its duty to protect Palestinians from settler violence in the West Bank.

The head of the International Court of Justice emphasized that the Zionist regime has accelerated the construction of new settlements in the West Bank, the number of which has exceeded 24,000 residential units.

Nawaf Salam clarified that this court believes that the Zionist regime’s control over the occupied Palestinian territories should be temporary and its continuation will be considered as annexation.

Salam said that the Zionist regime applied its special law in East Jerusalem after 1967.

He pointed out: We believe that Israel’s actions in East Jerusalem have created conditions in which Palestinians are unable to live.

He also emphasized that the actions of the Zionist regime have caused Palestinians to move from the occupied lands, especially Area C in the West Bank.

Nawaf Salam said that the implementation of internal laws of the Zionist regime in the West Bank has led to the strengthening of this regime’s control over the occupied territories.

Salam emphasized that the expansion of settlements in the West Bank and Quds and the construction of the barrier wall will strengthen the occupying regime.

He said that this court considers the actions and policies of the Zionist regime in Jerusalem and the West Bank to be their permanent annexation home.

The head of the International Court of Justice emphasized: We believe that treating Palestinians differently can be discrimination.

Nawaf Salam said that since 2009, the Zionist regime has demolished about 11,000 Palestinian residential units under the pretext of not having a construction permit.
Salam said: The systematic system of restrictions that Israel imposes on Palestinians is considered racial discrimination. Israel’s actions against the Palestinians violate Article 3 of the Convention against Racial Discrimination.

Nawaf Salam stressed that the policies and actions of the Zionist regime aggravate the violation of the Palestinians’ right to self-determination.

Salam said: This court will later deal with the legitimacy of Israel’s presence in the occupied territories.
