Brazil Joins South Africa’s Complaint Against Israel
According to the English section of webangah News Agency, the International Court of Justice (ICJ) declared that Brazil has formally intervened in South Africa’s complaint against Israel concerning alleged violations of the Genocide Convention in Gaza.
The court stated that Brazil submitted it’s intervention declaration on September 17 under Article 63 of the ICJ Statute. This article grants the right to intervene to states party to a convention being interpreted by the court.
Brazil indicated in its statement that, as a member state of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, it exercised this right.
It also emphasized that Articles 1,2,and 3 of the convention are at issue in this case and offered its legal interpretations for consideration.
The court underlined that any interpretation made in its final ruling will be binding on Brazil as well.
Accordingly, South africa and Israel have been requested to submit written opinions regarding Brazil’s intervention.
South Africa filed its case against Israel on December 29, 2023. It accuses tel Aviv of breaching obligations under the genocide Convention through attacks against palestinians in Gaza.
Sence then,the ICJ has issued provisional measures requiring Israel to prevent acts amounting to genocide.
This move brings Brazil into a group including Colombia, Mexico, Spain, Turkey, Chile, and Ireland-countries which have sought to intervene in this case so far.
The International Court of Justice is based in The Hague. It serves as the primary judicial organ of the United Nations tasked with resolving legal disputes between states.
