Germany Challenges ICJ Jurisdiction in Gaza Genocide Support Case Filed by Nicaragua

According to the International Desk of Webangah News Agency, Germany has argued before the International Court of Justice that the court lacks jurisdiction to hear a case brought against Berlin by Nicaragua. Nicaragua accuses Germany of playing a role in “facilitating genocide” in Gaza through its political, financial, and military support for the Israeli regime.

Berlin contends that the case should not proceed to substantive review because Israel, the principal party involved in the alleged actions, is not participating in the proceedings and has not consented to the court’s jurisdiction. Germany also claims that Nicaragua failed to meet the necessary prerequisites for demonstrating a legal dispute between the two nations prior to filing the lawsuit.

Nicaragua initiated this case in March 2024, asserting that Germany violated its obligations under the Genocide Convention and international humanitarian law by supplying arms and other forms of support to Israel. While the ICJ declined Nicaragua’s request for provisional measures against Germany in April 2024, it did not dismiss the case entirely.

Reports indicate that Germany has emphasized that its arms exports are subject to legal scrutiny and had imposed restrictions on arms sales to Israel in 2025. However, following the partial lifting of some of these restrictions, permits for military equipment exports valued at approximately 800 million euros were issued between January and June of the current year.
